21 DAYS IN JAIL for SELF-REPRESENTED INTERNET HARASSER ( not condo ) 2021/08/22 18:59
Not legal advice,as usual.

One would have blissfully hoped that neighbourhoods & pets in theory would tend to bring out the best in us. But sometimes . .

After a passage through the civil & minor criminal justice systems, a self-represented Aurora man will begin serving a 21 day jail sentence. That it took this long & so much court time to reach this stage, is a different matter worth pondering.

From section 372(4) & (5) Criminal Code RSC 1985, c C-46,

" . . .. Harassing

. . . . Harassing communications

(3) Everyone commits an offence who, without lawful excuse and with intent to harass a person, repeatedly communicates, or causes repeated communications to be made, with them by a means of telecommunication.

Punishment

(4) Everyone who commits an offence under this section is

• (a) guilty of an indictable offence and liable to imprisonment for a term of not more than two years; or
• (b) guilty of an offence punishable on summary conviction. " - unquote

Factuals : Whether foolish intervenor or ( withheld prudently ), a self-represented Aurora owner gets a 21 day jail sentence as contemnor & defier of “stop-harassing” court orders.

Had harassed multiple private & municipal targets since at least 2016. Ignores fines. ( Do fines work against everyone ? )

After intervening in another neighbour’s already-underway 2018 fence dispute, he waged massive “communication with intent to harass” campaigns on his own that actually drove a third neighbour to move out.

He was hit with criminal convictions amidst findings of 9 incidents of contempt of court. Latest is not yet at canlii.org
