ONTARIO RAISES SMALL CLAIMS limit to $ 35 K eff. JAN 1/20 but will it help lien challengers much? 2019/11/26 16:28

After ten years parked at a $25 K limit, Ontario's Small Claims Court will have its claim limit raised to $ 35 K effective January 1 2020.

It's still short of the $ 50 K limit set by Alberta in 2014.

Details are below along with some mixed opinions about the outcomes.

If fighting condo LIEN CHALLENGES in that forum, even successful condo corporations as winners can still suck up substantial legal costs due to the ( merely ) "guidelined" 15 % of claim in dispute.

But other topics at cafcor show that some unsuccessful lien challengers have been hit with huge & disproportionate costs award in the Ottawa area. One was even ordered to undergo a mental capacity exam / even selectively stripped of litigation powers without the challenge grounds even being addressed . . .

FUTURE TIGHT TIMEFRAMES TO CHALLENGE or otherwise RESPOND

The Province's E-laws website at Nov 26/19 continues to show as un-proclaimed, related changes to Ontario's Condominium Act 1998. The owner of a liened unit will be hit with an incredible 30 day limit to respond in any of 4 ways to a lien notice . One option is a judicial challenge ( pending the Tribunal ever receiving authority to go beyond record access issues.
