Whether to title it ‘the Death of April” ?
This tiny condo dog’s brutal killing – by a totally different unit’s allegedly mild & elderly ‘rescued’ pitbull type dog - incredibly within her owners’ own unit in a multi-storey Toronto condo highrise, raises some gob-smacking questions.
1 - Was the quickly euthanized but allegedly elderly dog invader/aggressor, in technical violation of DOLA ( Dog Owners’ Liability Act R.S.O. 1990, ch D.16
https://www.ontario.ca/laws/statute/90d16 ) and specifically of pit bull Definition (s 1) and the Pit Bull sections 6 – 11 ? With the invader quickly euthanized without Provincial Offence charges laid, this may not be so easy to prove in litigation.
2 - The aggressor has been described in the media by its pitbull rescue group as “a sweet, lazy, senior dog who was loved dearly by our staff and volunteers”. Is that why the allegedly elderly ‘Brownie’ was allowed un-restrained or inadequately restrained in the hallway, then forcing its way into the unit and killing April in front of her horrified owner ?
Media articles report silence of the owner(s) of the aggressor dog. Was their own unit door latch malfunctioning, someone’s maintenance duty being ? Had the non-defendant condo corporation been actioning some aspect of that presence ? )
3 - Prior to the incident how was this dog’s placement selected & in such a venue ?
Placing the aggressor dog under whatever good intentions, is there even a network of well-intentioned Rescuers of Pit bull type dogs actually being allowed to operate in Ontario ? Should any such rescued be placed other than in the most-controlled circumstances ?
4 - As now being discussed at a US HOA/condo site, what - short of litigation - if occupants refuse to register their pet and/or disclose its weight for purposes of a Weight Limit Rule ?
