Supervisor reports to one of the BODs rather than PM ? 2007/08/01 23:50
Suprindent is currently reporting to PM and BODs are not satisfied with it.
My question is Can PMC/Suprindent make a big deal about it if we changed ?
we dont find anything wrong in PMC and/or Suprindent contracts.

It is possible for the Board to have the Super report directly to them rather than the manager. However, I would have the condominium's solicitor double check both contracts first, as the manager may have the right to "manage the day-to-day" tasks required in operating the condominium such as which day the vacuuming is done, etc.

Do we have to pay for the lawyers for this, right ?

Most likely - unless it is covered by a retainer. However, I strongly suggest you get legal advise on this prior to making the change just in case (it will cost more money if the PMC claims the condominium is in breach of contract.)

You are right Wotan,I will do it accordingly.Thank you.
Do you know that PMC did not follow any by-laws since they were here with us..they have their own rules.....but they are threating with the laws...but we have never breached any.

No problem Jony, but hearing what your PMC is like, it is probably better to have the solicitor involved if only to have the solicitor draw up the appropriate letter informing the PMC of the organizational change being made.

We have to push our PM for every single thing. we have to ask updates regularly and then he will do his task..or ....they are not interesting at all..lots of complaints from owners....we even told the president of the PMC about him.....no improvement...i think we may let them go....it is not worth it.
All they need our money.

Has your board considered passing a resolution to make an official complaint to the ACMO about this PMC?

Long story short,in next 2 month The PMC will be the history.by the time we may have more issues.dont you think it would be better to complain after they left ? or do we have to do while they manage us ? do you think it is worth it to complaint ? did you have any experiences with ACMO ? can we trust them ?

Jony,

Has your Board considered employing an "independent PM" instead of going to another PMC? You say that the current PMC will be "history" in two (2) months. You also state that you would like your Corporation's Superintendent to report directly to the BOD. Perhaps another PMC is not your answer.
