A gob-smacking 13 years after a BC court yanked a Penticton B.C. commercial motel strata’s management out of the hands of the dominant investor owner / rental pool manager, there’s a reimbursement Order against the mis-manager. Will it get collected ?

The motel strata was “Tiki Shores Condominium Beach Resort” located at 914 West Lakeshore Drive, Penticton B.C.

The controlling group / rental pool manager, the entity’s then-controlling owner & its prior owner, are now ordered to reimburse $ 74 K to the strata corporation and to pay legal costs TBD.

As rental pool manager the dominant group are ruled to have comingled funds.

And to have left records in chaos after purging joint accounts access & counter-signature out of the hands of whomever would be strata President from time to time .

Judgment cites the defendant’s admission of accounting incompetence & tale of a magical disappearance of records.

A cautionary tale for those who think that strata or condo models are necessarily safer for investors.

Or somehow subject to prompt redress after a judicially appointed administrator arrives to find chaos – deliberately left or otherwise .
