Permission from the developer....

We know that has no legal force and does not bind or restrict an elected board.

Instead of just calling the landscaper and ripping out the offensive plants, the board is making money at the 60 buck a day US, fine, their rules allow.

Boards here in Ontario would love the ability to fine too.

This woman is going to end up paying a big price for fighting with her board. I don't see how she can win.

She made a deal with the developer.

The developer is gone.

The developer cannot bind the board.

The board likes the income stream instead of just fixing it and sending her one bill after its fixed.

I am sorry to say that this lady is incorrect. The Board is trying to have a standard look for the front yards - there is nothing wrong with this and may help keep property values up (as owners cannot have a run down front yard either.)

However, if the developer and the owner had made an agreement that formed part of the sale of the unit, it could be argued that the exception is allowed. But I believe it would have to be found on the deed for the unit, or at least attached to the deed. But I am not a lawyer so may be incorrect.
